Understanding Your Malpractice Coverage

Occurrence vs. Claims-Made

The two malpractice policy forms cover you very differently. An occurrence policy covers any incident that happens during the policy period no matter when the claim is filed – even years later – making it simpler and gap-free, but usually more expensive up front. A claims-made policy only responds if the policy is active both when the care occurred and when the claim is reported; it starts cheaper and steps up over the first several years, but it leaves a gap the moment you cancel, switch carriers, or retire. Choosing between them isn’t about year-one price – it’s about your true multi-year cost and how you plan to eventually wind the policy down.

Tail Coverage, Explained

If you carry a claims-made policy, tail coverage (an Extended Reporting Period) is what protects the years you’ve already worked once that policy ends. It covers claims reported after your policy terminates for care delivered while it was active – which is exactly what you need when a physician retires, becomes disabled, passes away, or leaves the group. Purchased unexpectedly, tail can cost 150–300% of your annual premium, so it should never be an afterthought. Several of our carriers include complimentary tail on death, disability, and retirement – a provision we prioritize when we place your coverage.

State Requirements: PA & NJ

Malpractice requirements vary by state, and getting them wrong can jeopardize your hospital privileges and licensure. In Pennsylvania, physicians don’t insure through a single policy: under the MCARE Act, you must carry primary professional liability coverage and also participate in the MCARE Fund, which adds a layer of excess coverage above your primary limit – and the two layers have to be coordinated correctly to stay compliant. New Jersey generally requires physicians to carry medical malpractice liability coverage (commonly $1M per occurrence / $3M aggregate) or an approved alternative such as a letter of credit for those unable to obtain coverage. In both states, hospital credentialing and payer contracts often impose their own minimum limits on top of state law – so we confirm every applicable requirement before placing your coverage.
